Terms of Service

These terms set out the agreement between you and us when you use Munchies. We've kept them in plain English because terms you can't read aren't fair terms. By using Munchies, you agree to them, so it's worth a couple of minutes.

The heart of it: Munchies is a free tool that helps you decide what takeaway to order. It does not deliver food, take orders, or take payment for food, and that shapes what we can and can't be responsible for.

Munchies is in development and available as early access by enquiry.

1. Who we are

In these terms, 'Munchies', 'we', 'us' and 'our' mean Avanti Mind Ltd. 'You' and 'your' mean the person using Munchies.

2. What Munchies is, and is not

Munchies is a discovery and comparison tool. It brings together restaurant and menu data for takeaways in the areas it covers, and helps you decide what to order through search, recommendations, price comparison and a meal builder.

Munchies is not:

A food delivery service. We do not employ drivers and we do not deliver food.
An ordering platform. You do not place orders or pay for food on Munchies. When you have decided, Munchies links you to a third-party delivery platform, where you order and pay.
A restaurant or food business. We do not cook, prepare, sell or handle food.
A review platform. Where ratings are shown, they are aggregated from third-party sources.

3. Using Munchies

3.1 Eligibility

Munchies is intended for adults (18 or over). By using it, you confirm you are old enough to do so.

3.2 Accounts

The core of Munchies can be used without an account. Some features, such as price watches and office rounds, need an account.

3.3 Acceptable use

You agree to use Munchies lawfully and reasonably. In particular, you agree not to:

use Munchies for unlawful purposes;
attempt to gain unauthorised access;
copy or scrape data without permission;
interfere with or disrupt Munchies;
introduce malicious code;
misuse the contact or reporting features;
or infringe anyone else's rights.

4. Accuracy of information: important

Munchies works hard to keep its restaurant and menu data accurate, fresh and complete. But you should understand the limits: data comes from restaurants' own websites and other sources that we do not control. Prices, menus, opening hours and restaurant details can change at any time. Always confirm the final details, especially the price, with the app or restaurant you order from before you place an order.

5. Allergen and dietary information: please read

Allergen information shown on Munchies comes from the wording on a restaurant's own published menu, with its source and date, and reads NOT KNOWN where nobody has said. Vegetarian, vegan and halal labels are worked out by software from menu text. Munchies does not check any label with the restaurant, so a label may be incomplete or incorrect.

If you have a food allergy, intolerance or other dietary requirement, you must always confirm allergen and ingredient information directly with the restaurant before ordering or consuming any food.

6. Third-party platforms and links

When you tap through from Munchies to a delivery platform or the restaurant's own site, you leave Munchies and enter a separate service operated by someone else. Your order, payment, delivery and relationship are entirely with that platform and the restaurant. We are not responsible for their content, accuracy, availability or conduct.

We do not currently earn anything when you tap through. Nothing paid ever influences what Munchies recommends.

7. Pricing and payment

The core of Munchies is free to use. Munchies is free while we launch in Coventry. Prices, if there are any, will be published before anyone is asked to pay. You never pay Munchies for food. Any payment for food is made on the third-party delivery platform, under that platform's terms.

8. Intellectual property

The Munchies name, logo, website, design, text, software and the way it organises and presents information are owned by Avanti Mind Ltd or used under licence. You may use Munchies for your own personal, non-commercial purpose. You may not copy, reproduce, republish, sell, or commercially exploit any part of Munchies, or extract or reuse its data, without our prior written permission.

9. Availability of the service

We aim to keep Munchies available and working well, but we do not guarantee that it will be uninterrupted, error-free or always available. We may change, suspend or withdraw all or part of Munchies at any time.

10. Our responsibility to you

We provide Munchies with reasonable care and skill. But because of what Munchies is (a free tool that helps you decide, not a food, ordering or delivery service) there are limits to what we can be responsible for. To the fullest extent permitted by law, we are not responsible for the food itself, orders, payments or deliveries, or inaccuracies in third-party data.

Nothing in these terms limits or excludes our liability where the law does not allow it, including liability for death or personal injury caused by our negligence, or for fraud. This clause does not affect your statutory rights as a consumer.

11. Your responsibility to us

You agree to use Munchies responsibly and within these terms. If your misuse of Munchies causes us loss or a claim from someone else, you may be responsible for that loss to the extent the law allows.

12. Changes to these terms

We may update these terms from time to time. When we make a significant change, we will update the 'Last updated' date above and, where appropriate, tell you. Continuing to use Munchies after a change means you accept the updated terms.

13. Governing law

These terms, and any dispute arising from them or from your use of Munchies, are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. Nothing here affects your rights as a consumer.
